The
World Shipping Council, which
represents container shipping
lines in the US and the National
Industrial Transportation League,
which represents importers and
exporters in the US, have agreed
to back the move to reform the
global reform liability rules.
The
agreement by the two bodies to
back the reform cargo liability is
now expected to boost the efforts
to draw up a new international
convention under the aegis of the
United Nations.
The
reform proposed by the Comite
Maritime International aims at
drafting a new reform cargo
liability will be presented to the
United Nations Commission on
International Trade which is due
to start negotiating a new
convention next year.
The
agreement by the two US bodies is
expected to move forward the new
liability rules which have been
stalled for many years due to
differences between various
maritime interests.
The
agreement recognizes carrier’s
and shipper’s freedom to
negotiate contracts as established
bythe Ocean Shipping Reform Act.
It
provides for the elimination of
the error of navigation defence
and the adoption of the Hague-Visby
liability limits as part of the
new international convention; an
promotes international uniformity
and predictability in the law
governing the international
movement of ocean cargo.
