The
legal fraternity in Asia has been
urged to look within the region
for expertise and knowledge in
dealing with maritime legal issues
instead of depending on the West.
Making
the call, the executive chairman
of Halim Mazmin Bhd Tan Sri Halim
Mohammad, said lawyers and firms
in Asia specializing in admiralty
law, insurance and related matters
could share their knowledge for
the development of the specialty
expertise in the region.
Halim,
who was speaking at a seminar for
marine insurers in Kuala Lumpur,
said Malaysia which has declared
its intention to become a maritime
nation should foster the
development of such a specialty
expertise for the benefit of the
maritime community in the country.
The
seminar for marine insurance
professionals in Malaysia was led
by Dato Jude P Benny, one of the
most respected admiralty and
shipping lawyers in Asia.
Benny,
in his presentation urged lawyers
dealing with insurance and related
issues to take a holistic view of
things in order to understand
issues in litigation because a
marine adventure brings into play
different types of insurance
policies such a hull &
machinery, marine cargo and
protection and indemnity.
“A
true professional in the marine
industry must have a clear
helicopter understanding of how
the different covers interplay, so
that a risk can be better covered
or a claim better made or a
casualty better managed,” he
said.
Benny,
who has also developed special
interest in oil pollution urged
the Malaysian government to
consider ratifying the 1992
protocol to the International Fund
Convention (IOPCF) that sets
higher limits for claims including
such compensation to beach resorts
a sum of US$12 million for closure
of beach for two weeks because of
oil pollution.
